Terms of Service

By accessing or using Enclave Social ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Enclave Technologies LLC. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

Enclave Social is a private, end-to-end encrypted community and creator monetization platform operated by Enclave Technologies LLC, a Mississippi limited liability company. The Service allows users to:

• Create and join encrypted servers and channels
• Send and receive end-to-end encrypted direct messages
• Subscribe to creator content and exclusive communities
• Monetize communities through subscription tiers

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service. By using Enclave Social, you represent and warrant that you meet these eligibility requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Not share your account with any other person

Enclave Social will not be liable for any loss or damage arising from your failure to maintain the security of your account.

You are solely responsible for the content you send through the Service. Because we cannot read your messages, we cannot proactively moderate encrypted content. We rely on user reporting to identify violations of these Terms.

Token purchases and platform upgrades can be completed in-app on iOS and Android or on the web at enclave.talk. Web purchases avoid mobile platform fees, so creators and members may prefer web for larger purchases.

Enclave Social collects a 10% platform fee on all creator subscription revenue. Creators retain 90% of all subscription revenue generated through the platform.

Refunds are handled on a case-by-case basis at Enclave Social's discretion. Subscription fees are non-refundable except where required by applicable law.

You agree not to use the Service to:

• Transmit illegal content or facilitate illegal activities
• Harass, threaten, abuse, or harm other users
• Distribute malware, spam, or unauthorized advertising
• Attempt to circumvent encryption, security measures, or access controls
• Impersonate any person or entity
• Violate any applicable local, state, national, or international law
• Distribute child sexual abuse material or any content that exploits minors
• Engage in coordinated inauthentic behavior or platform manipulation

Violation of these prohibitions may result in immediate account termination and referral to law enforcement where applicable.

You retain full ownership of all content you create and share through the Service. By posting content on Enclave Social, you grant Enclave Technologies LLC a limited, non-exclusive, royalty-free license to transmit, store, and deliver that content solely for the purpose of providing the Service to you and other users.

This license terminates when you delete your content or account, subject to reasonable technical delays in propagation.

Enclave Social reserves the right to suspend or permanently terminate accounts that violate these Terms, at our sole discretion and without prior notice.

You may delete your account at any time through the app settings. Upon deletion, your account data will be removed from our systems subject to our data retention policies and applicable legal requirements.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Enclave Social does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not warrant the accuracy, completeness, or reliability of any content transmitted through the Service by other users.

To the fullest extent permitted by applicable law, Enclave Technologies LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

In no event shall Enclave Social's total liability to you for all claims exceed the amount you paid to Enclave Social in the twelve months preceding the claim, or $100, whichever is greater.

These Terms are governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Mississippi.
